These Terms of Service (“Terms”) govern your use of Age With Flavor, my.Age With Flavor, and any related services (the “Site”), operated by Perks Media LLC (“we,” “us,” or “our”).

By using the Site, placing an order, or signing up for our email list, you agree to these Terms. If you do not agree, do not use the Site.

Who can use the Site

You must be at least 18 years old to make a purchase or create an account. By using the Site, you confirm you are at least 18.

What you’ll find on the Site

Age With Flavor publishes books, recipes, digital products, courses, and related health and wellness content under multiple pen names. We sell physical books, digital products, and link to additional titles available on Amazon as an Amazon Associate.

Content on the Site, including recipes, articles, and book content, is for informational and educational purposes only. It is not medical advice. See our Medical Disclaimer for more.

Orders, pricing, and payment

When you place an order, you make an offer to purchase the product at the listed price. We accept your offer when we send an order confirmation. We may refuse or cancel an order if we suspect fraud, if the product is unavailable, or if the price was listed in error.

Prices are in U.S. dollars and do not include sales tax, which will be added at checkout where applicable.

Payment is processed by GoDaddy Payments and Stripe. You authorize us (through our payment processors) to charge your selected payment method at the time of purchase.

Shipping

We ship physical products to addresses we can verify. Shipping times are estimates, not guarantees. Once a package leaves our hands (or our fulfillment partner’s), shipping carriers are responsible for delivery. We are not liable for carrier delays, lost packages, or packages marked delivered that the customer cannot locate, but we will help you file a claim with the carrier where possible.

International shipping, where offered, may be subject to customs duties and taxes that are the customer’s responsibility.

Returns and refunds

Physical books and products: You may request a refund within 30 days of delivery, provided the item is returned in resaleable condition. Buyer pays return shipping unless the item arrived damaged or we shipped the wrong item. Refunds are processed within 5-7 business days of receiving the return.

Digital products and PDFs: Because digital products are delivered immediately and cannot be returned, all digital product sales are final. If you experience a delivery problem (e.g., download link failure), contact hello@agewithflavor.com within 7 days and we will resolve it.

Courses: Refund terms are stated on the course sales page at time of purchase and govern over this section if they conflict.

Amazon-linked books

Some books linked from the Site are sold through Amazon, not directly by us. When you click an Amazon link, you leave our Site and Amazon’s terms, policies, and refund rules govern that purchase. We earn an affiliate commission on qualifying Amazon purchases, see our Affiliate Disclosure.

Email and marketing

When you sign up for our email list or download a free resource, you agree to receive emails from us. You can unsubscribe at any time using the link at the bottom of any email. We use AWeber to send and manage email, see our Privacy Policy for details.

Intellectual property

All content on the Site, including book text, recipes, articles, images, logos, course material, and downloadable resources, is owned by Perks Media LLC or our content partners and is protected by copyright and trademark law.

You may:

• Print one copy of a recipe or article for personal, non-commercial use
• Share a link to our Site on social media
• Quote short excerpts with attribution and a link back

You may not:

• Republish our content on another site or in any commercial product
• Use our content to train AI or machine learning models
• Resell, sublicense, or redistribute any digital product you purchased from us
• Use our trademarks (including pen names and book titles) without written permission

User conduct

When using the Site, you agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site
• Disrupt the Site, its servers, or its network
• Scrape, harvest, or otherwise collect data from the Site (including for AI training) without our written permission
• Submit false, misleading, or defamatory reviews
• Upload or transmit any virus, malware, or harmful code

Reviews and user-submitted content

If you leave a review or submit any content to the Site, you grant us a worldwide, non-exclusive, royalty-free license to use, edit, display, and share that content in connection with our business. You confirm that the content is yours, is truthful, and does not violate anyone else’s rights.

We may remove any review or submitted content at our discretion, including content we believe is fake, off-topic, or violates these Terms.

Disclaimers

The Site, its content, and any products sold through it are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Perks Media LLC and its affiliates, contractors, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Site or any product.

Our total liability for any claim arising out of these Terms or your use of the Site will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow these limitations, in which case they apply only to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Perks Media LLC, its affiliates, and its team from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third party’s rights.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Site will be resolved in the state or federal courts located in Washington, and you consent to the jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Changes to these Terms

We may update these Terms from time to time. The current version is always posted on the Site with the “Last updated” date. Continued use of the Site after changes means you accept the updated Terms.
